Lawyer Tuy Denies Harassment Claims, Pursues Defamation Case Against Pu Mantana Without Settlement

The case remains a hot topic in the entertainment industry regarding Noom Kanchai who has appointed Mr. Pornsak Wipasaparnon, also known as Lawyer Tuy, to pursue defamation by advertising lawsuits against Pu Mantana, totaling five cases concerning posts implying she is a "media mafia" and extending accusations to the family.

Recently, after the opposing party went to acknowledge the charges and publicly claimed harassment, expressing confidence in winning the case, Lawyer Tuy clarified that although no real names were mentioned, if surrounding evidence and context allow the public to understand who is meant, it still constitutes an offense under the law. He stated that both the media and society agree on who the posts refer to, making the posts admissible as evidence in court. The lawyer firmly confirmed there will be no mediation, stating, "No money, no gift baskets," and no acceptance of apologies.

He added that the main objective is to seek criminal penalties to create awareness, as money cannot stop repeated misconduct. Another reason for refusing settlement is that the posts involved Noom Kanchai's daughter and wife, who are unrelated to the dispute. Lawyer Tuy emphasized that the family should not be involved and viewed such behavior as highly inappropriate. Legally, defamation by advertising can be prosecuted in any district where the offense occurs.

He further explained that reposting the same message repeatedly each day constitutes a new offense and can lead to additional lawsuits, not double prosecution. The lawyer advised the opposing party to heed their own counsel's advice and be cautious in public legal statements, as inaccurate media information could affect the case's future. He concluded by reflecting the stance: "How can a victim bow to the wrongdoer?" The case remains to be followed to see how the court will ultimately decide.
