Progress in the lawsuit between Poo Mantana and Lawyer Decha and Lookmee Rasamee Today, the South Bangkok Criminal Court issued a judgment dismissing the case in the entire defamation matter. The court found that the allegations during the preliminary hearing lacked sufficient weight and that the case was baseless, resulting in the case's conclusion. Lawyer Decha personally posted a video announcing this good news on the Facebook page 'Lawyer Relief' to inform the public and followers.
"Hello respected citizens and dear fans of Professor De. Today at 9:00 a.m., the South Bangkok Criminal Court ruled on the case where Poo Mantana was the plaintiff suing Lawyer Decha as Defendant No. 1 and Lookmee as Defendant No. 2 for defamation by advertising and improper debt collection."
"Today, the court held a hearing on the preliminary examination and ruled to dismiss the case due to lack of grounds, meaning that Lawyer Decha and Lookmee are not guilty of defamation or improper debt collection. There were five key issues involved."
The first issue: The court stated that Poo Mantana filed a defamation lawsuit without attaching the video clip and transcript of the speech, which is not in accordance with Criminal Procedure Code Section 158(5), rendering this part of the filing unlawful.
The second issue: Upon reviewing the documents attached by Poo Mantana, it was found that Lawyer Decha and Lookmee did not defame Poo Mantana by claiming she owed 2 million baht and had not paid. No such statements were found. Thus, the accusation of alleging a 2-million-baht debt without repayment was unsupported, and the court dismissed this issue.
The third issue: Regarding the clip submitted to the court showing Poo Mantana, Lookmee, and Lawyer Decha disputing at Thonglor Police Station, the court found the statements were not defamatory. Both sides explained themselves, and from a reasonable person's perspective, the plaintiff was not harmed. The exchanges were considered fair opinions in response to each other.
The final issue accused Lookmee of being an illegal loan shark with multiple debtors. Poo Mantana failed to provide evidence. Therefore, Lookmee is not a debt collector under the Debt Collection Act, and Lookmee's actions are not public debt collection or improper methods.
