The program "Hone Krasae" on Channel 3 hosted by Khun Kanchai Kamnerdploy interviewed Lawyer Saiyud Pengboonchu also known as Lawyer Pacquiao regarding taking on the case of Nana Raibina. Yesterday, when she was bailed out with a 50 million baht bond—is that the actual amount for bail during the investigation? Lawyer Saiyud explained that, in principle, it is almost never the case that bail is granted at the police station or precinct level requiring one-third of the damage amount. Who could provide 50 million baht? Instead, the court considers bail based on the maximum penalty for the charges. Here, the highest charge is under the Emergency Decree on Borrowing, involving fraud against the public. The court’s minimum bail amount for this offense is 500,000 baht.

However, there are multiple fraud allegations, including claims of stock trading scams with documents involved. I calculated what my client could afford, so I initially proposed 1 million baht, giving 1-2 hours to raise it in cash. I only put down 1 million baht. The amount of damage—whether fraud of 100 million or 1,000 baht—the penalty is the same. Some say the damage is large and widespread, but that is not the law. I submitted 1 million baht with nearly 10 supporting reasons.

Regarding the reasons, we noted it is only the complainants' side accusing, pointing out parts of the damage claimed. The total damage according to the custody request was over 160 million baht. Initially, news reported 400 million baht, but that dropped by 250 million baht. The suspect has not done anything yet. The damage amount dropped drastically by 250 million baht. The official custody request stated just over 160 million baht, with police submitting 152,907,500 baht. I pointed out some victims are grouped into four categories: Group 1 claims money was used for stock trading; Group 2 alleges being scammed into lending businesses, using various wording; Group 3 invested in various companies; Group 4 involved borrowing money.

I consider the lending group important because some have acknowledged debts of 90 million, 70 million, and 64 million baht, totaling over 400 million baht using debt acknowledgment letters. I said this is inconsistent. Therefore, you cannot just believe the victims' side; you must also hear the suspect. The key principle for temporary release considered by the court was that there was no flight risk. On that day, I went with my team and told Nana and her sister to wait because there was a rumor that a warrant would be issued on the 3rd.

I arrived on the evening of the 1st and tried to go to the central investigation unit, which is the largest there. The police chief was due to transfer, and the replacement had not arrived. I met with the investigators and went to the detention building in front, but no one came out after almost an hour. So, I called the deputy investigation chief to express my intention. If there was a warrant, I would bring her to surrender immediately. If no warrant, just inform us when charges are filed, and we would bring her in without wasting time issuing a warrant.

Regarding the police chief saying he didn’t know if Nana came or not, actually, Nana used her own ID card to enter because entry to the central investigation requires showing ID, giving a contact number, and stating who to contact. You can check that. I waited for two hours until 7 p.m., but no one came. So, I told Nana to take a photo as evidence since all proof is with the police. Otherwise, they might claim she didn’t come. I inserted Nana’s ID card to have it recorded that she was present.

But they did not accept her as a suspect, saying she did not yet have the legal status of a suspect. However, in reality, once someone is accused and a complaint is filed, that person is considered a suspect. I detailed this in my court submission with photos, stating she had surrendered and providing full contact details. I asked the court to summon the police officers involved for examination.
