After the actress Noon Waranuch and Todd Pitipornpakdee came to the Taling Chan Criminal Court to mediate a defamation lawsuit against Ajarn Aui Chanitha Satsue a famous fortune teller and former close friend of Moddam Kotchapha, regarding an audio clip in which Ajarn Aui allegedly disparaged Noon and Todd, causing them harm.
Recently, it was revealed that Ajarn Aui did not attend court for mediation. The defendant's lawyer stated that the defendant declined mediation due to personal reasons, leading the court to proceed with evidentiary hearings. The next court session is scheduled for 6 Feb at 09:00 at Taling Chan Criminal Court. Noon and Todd, along with Lawyer Kaew, shared their thoughts on this matter.
- Lawyer Kaew stated that the defendant did not come to court, so their lawyer declared they did not wish to mediate. Consequently, the court moved to the evidentiary hearing phase. The reason for declining mediation was personal; they might not have been available. It’s best not to intrude on their reasons. The court asked plaintiffs Noon and Todd if they wished to meet. I said we wanted to, but since the defendant didn’t appear, the mediation process couldn’t start.
- I feel a bit that mediation is a conversation before legal proceedings and cannot be used as evidence. It would be better to talk, but I respect their rights and will not speculate on their personal reasons.
- Noon said that as Lawyer Kaew mentioned, everything is proceeding according to process.
- Todd said it is their right and he respects everyone’s rights. The court wished to mediate. Both he and Noon came in person, but the defendant clearly expressed they did not want mediation. That is their choice and decision. As for his feelings, everything is proceeding according to the laws and justice system.
- When asked if mediation could have resolved the case, Todd said he can’t say. Mediation depends on words, content, and suitability. If they can’t agree, it can’t be resolved. So he really can’t answer since the defendant didn’t come.
- Asked if he had any worries, Todd said no, because everything is clear from the statements already given. Asked if he has an answer if the case proceeds, he said it will follow legal rules.
- On whether the defendant might apologize or reach out privately in the future, Lawyer Kaew said it’s best not to speculate. Some things are their rights. They have the right to cross-examine. As the plaintiffs’ lawyer, I am doing my duty by having the plaintiffs testify. The court will consider this. We will address it again at the next hearing.
- The next hearing is scheduled for 6 Feb at 09:00 at Taling Chan Criminal Court. It will involve cross-examination of witnesses who are my key evidence. All evidence has been submitted for consideration.
- Regarding the defendant’s defense, Lawyer Kaew said that is their right. They can defend as they wish. Since I filed a defamation claim causing damage to reputation and property, they have the right to cross-examine.
- On any concerns, Lawyer Kaew said he is not worried but wished both parties could meet as the court intended — to talk before the case proceeds. But since they did not come, he understands their reasons.
- About whether Moddam Kotchapha will sue that fortune teller, Lawyer Kaew said he is not aware. That is their decision. He is only responsible for these two plaintiffs and this case.
- Noon briefly responded that everything is proceeding according to process and steps, with Lawyer Kaew assisting. Since it is a court matter, the court decides. Noon lets things follow their natural course.
- Asked if it is good for celebrities to defend their rights, Noon said it is her right to protect herself and Todd. When asked if she wanted to say anything to the fortune teller, Noon shook her head and said no.
- When asked if Todd was acting as Noon's bodyguard today, he replied lightly, “Huh?” A reporter said it was his look today. Todd said, “I usually dress like this.”
