After Luk Mee Rasamee filed a lawsuit against senior actress Poo Mantana for fraud, with the verdict scheduled at the Phra Nakhon Tai District Court, the court of first instance, on the morning of 22 Apr 2026 GMT+7.
Recently, the lower court sentenced Poo Mantana to 2 years imprisonment for fraud related to deceptive investment solicitation, but acquitted her of charges under the Cheque Act. The sentence is to run consecutively with a prior 2-year defamation sentence handed down by the Bangkok South Criminal Court.
After the court session, lawyer Kung and Luk Mee gave interviews to the media, stating that
lawyer Kung said, "Luk Mee filed two lawsuits against Poo Mantana: one for fraud involving deceptive investment solicitation, for which the court sentenced her to 2 years imprisonment without suspension, to run consecutively with the previous defamation case of 2 years. The defendant failed to provide evidence showing that the money Luk Mee transferred was invested in any business. Instead, proof showed the funds were passed to another person unrelated to the investment business, constituting fraud—deceptive investment solicitation—resulting in a 2-year prison sentence."
Regarding the Cheque Act charges, the defendant had issued multiple cheques, the last being for 2 million baht, frequently replacing cheques. The court noted both plaintiff and defendant were aware the defendant lacked capacity to honor the cheques, yet the plaintiff accepted them and allowed the defendant to issue cheques knowing the inability to pay. The court viewed these as possibly collateral cheques given repeatedly, and since the plaintiff accepted several cheques and allowed installment payments, the court dismissed the Cheque Act charges.
The sentence is immediate imprisonment of 2 years from the previous case without suspension. If the defendant does not post bail today and accepts the sentence, she will enter prison immediately. Currently, the defendant is applying for bail with a request for temporary release, with bail set around 200,000 baht according to the defendant’s lawyer.
However, the bail collateral is rented property, meaning the defendant must pay a new rental fee even if using the same collateral. The collateral for bail is less than the full amount, possibly only tens of thousands baht.
Luk Mee intends to file an objection to the temporary bail request, citing that the defendant already has a prior sentence without suspension and another pending defamation case filed by Luk Mee, suspended for 2 years, plus about 10 other defamation cases against others. The objection was submitted, but all is up to the court’s discretion. Typically, courts grant bail if the case is not severe, allowing the defendant to appeal, which we are confident she will.
Luk Mee said, "I’m glad to have won the case today. If Poo Mantana is granted bail, we will accept the court’s decision and continue with normal life. There are still other ongoing cases. If Poo Mantana continues posting defamatory messages or using my or lawyer Kung’s photos without permission, we will take further legal action because we want her to stop this behavior. If we are guilty, we accept punishment."
"I’ve been waiting for this day for a week. Win or lose, I wasn’t anxious. Now we have closure on this case. We know Poo Mantana will serve 2 years because her actions truly involved soliciting investment. We never distorted facts or did anything illegal or harmful to her, but she distorted the truth, accused me of falsifying reports and tricking her into signing documents. She claims I’m at fault in every case, but she is the one guilty. I believe such a person lacks conscience."
"Listening to the verdict was nerve-wracking, but I was 100% confident I would win because I was right. I just wondered how many years she would be sentenced to—I was so anxious it felt like my heart would leap out."
"I saw Poo Mantana in court. Initially, my friends were allowed into the courtroom, but Poo Mantana requested they leave, speaking in an angry tone that showed she was quite stressed and upset, judging by her facial expression."
Lawyer Kung said, "Today’s ruling confirmed that everything we claimed was true and that what she said was false. The court based its decision mainly on the timeline and chat messages in LINE, which clearly showed investment solicitation. The court explicitly stated the content was about inviting investment, not loan solicitation."
When asked about the chances of recovering the money, Luk Mee said, "I’ve long given up hope and accepted the situation. Winning the case is a success after two years. Whether she goes to prison for 2 years and pays 2 million baht or not doesn’t matter. We also won a civil case where the court ordered her to pay 1.7 million baht. I continue living and working as usual. I thank everyone for their support because fighting someone like this in such circumstances is exhausting for the whole country. Thank you to everyone who trusts that I told the truth and did not mislead or scam anyone. We’ve won."
Asked if she would show leniency if the defendant cried in court, Luk Mee said, "No. If Poo Mantana has money, she can repay 1.4 or 1.5 million baht immediately. I have withdrawn all cases as usual. As for the crying, she has cried in every case consistently, so it’s normal and has no effect. We don’t know if the tears are genuine or fake. She doesn’t know me, and I don’t know her."
Luk Mee concluded by advising Poo Mantana, "You must be very mindful. If you accept your guilt, life can move forward. But if you don’t, there are 24 more cases waiting for you. You must bravely admit your mistakes once, and your life will improve. A good conscience will help you survive. Without it, don’t even talk about the law. To live in society, you must first accept responsibility yourself."
Lawyer Kung added, "If she stops posting and using social media, her life will improve. Before the verdict, news reported posts defaming various people. Everyone with us has been affected. This invites more cases against her because she defames others. If she stops posting, she will avoid further complaints and won’t have to complain about being sued. All cases come from her posts about others and have nothing to do with us."
Luk Mee said, "I have 5 cases, and others have theirs. When Poo Mantana says they are exposing her, I say no one exposes anyone except themselves. I encourage her to keep fighting and not give up."
