Due to prior commitments, Noom Kanchai authorized lawyer Tuy, or Mr. Pornsak Wipasaphanont, his personal attorney, to attend the court hearing. Lawyer Tuy told reporters, “Today the court scheduled evidence inspection and testimony hearings, which are standard procedures once the court finds the case has merit. The defendant must respond and evidence is examined. This case involves 22 charges. The court set the trial dates for 1 and 2 April next year because the court has a heavy caseload.”
“On Noom Kanchai's side, there are four witnesses: Noom himself, a forensic linguistics expert to confirm whether the posts refer to Noom, and a neutral witness. It is the lawyer's duty to present evidence to prove wrongdoing and ensure the offender is held accountable.”
How serious are these 22 charges legally?
“If the court finds that all charges are proven against Noom Kanchai, penalties will be applied to each charge. Whether sentences are suspended is at the court’s discretion.”
When asked about the previous update of 64 charges, how many are there now?
“We added one more case with 14 charges, totaling 6 cases and 78 charges. Additionally, there is one charge under the Computer Crime Act related to a post falsely claiming Noom sent associates to cause trouble at the Phra Nakhon Tai District Court. For this case, Noom did not give any special instructions, just told us to do our duty. Since there is defamation and distortion, legal procedures must be followed. Since I started handling Noom’s cases, he never insults or speaks about the other party, only telling me to perform my duty. Meanwhile, the other party continues to post, and their language is suggestive.”
Recently, Noom said he filed 6 cases against Poo, with the latest being regarding the claim that Noom’s associates caused disruptions at the Phra Nakhon Tai District Court. Has this been filed?
“Yes, it has been filed. One of these is a Computer Crime Act charge; the others are defamation. Since the other party does not change their behavior and continues to challenge, claiming they did not mention names, media colleagues can read and understand who is involved.”
Regarding the case accusing Noom’s associates of causing disruption at the Phra Nakhon Tai District Court, how severe is the Computer Crime Act charge?
“It involves computer data distortion causing harm to Noom. The penalty can be up to 3 years imprisonment or a fine up to 60,000 baht. This case is negotiable. It was filed within the statute of limitations. On the day, witnesses Look Mee and lawyer Kung will testify.”
Initially, Noom intended for Channel 3 to file the case, but eventually filed it himself, correct?
“Yes, Noom intended to do so. He publicly stated when the news broke that he was harmed and should exercise his rights. The Channel 3 executives’ decision is at their discretion.”
With 6 cases now, is there a chance more will be added since social media disputes continue?
“The other party keeps opening and closing Facebook accounts. I believe there is definitely a chance more charges will be added as long as they continue using suggestive or defamatory language.”
Previously, Poo mentioned having 3 cases in 3 courts to attend. Poo said Noom and lawyer Tuy knew Poo had a 9:00 AM hearing at Minburi Criminal Court, but Noom and lawyer Tuy also filed at Ratchada Criminal Court at 9:00 AM, forcing Poo to rush. Any comment on this?
“That’s just complaining without understanding. She has lawyers who should know legal procedures. Why would I harass her when lawyer Kaew exercised her right to schedule hearings? I scheduled a hearing at the South Bangkok Criminal Court. Sometimes schedules overlap because the court sets the dates, not us. If she doesn’t know the facts, she shouldn’t accuse others. This is why these cases keep going on without end.”
Can you explain whether parties can set their own court dates and times?
“Usually, the court sets hearing dates based on availability of parties and the court. Overlaps happen by coincidence. Some hearings don’t require attendance; don’t complain about scheduling. For example, for the morning hearing, she must attend, but for the afternoon hearing I filed, she’s not a defendant yet and does not need to attend. So why complain and mislead the public?”
Do you confirm that Noom and you did not intentionally cause her to miss court appointments?
“Why would we do that? It’s normal for cases in different courts to have overlapping hearings. No one wants to harass anyone. She should stop harassing others. She even involves my wife unnecessarily. I don’t know why. Don’t compare; the public on social media knows who is who and who the real person is.”
She said there’s a new version of herself?
“I haven’t seen a new version, only the old version. She doesn’t update except for 3-4 days when she deactivates Facebook then returns the same. Maybe she wants to possess the old self.”
She said she won’t post insults anymore?
“Personally, I don’t believe that. People rarely change. To change, she must stop. If she doesn’t stop, cases like this will continue. Don’t accuse others. Also, I tell her not to lecture me on law; she should study law before teaching me. I’m a legal professional and read laws and regulations. She should teach herself first.”
This afternoon, there’s another case where lawyer Tuy is plaintiff suing Poo, scheduled at 9:00 AM as well?
“She requested to postpone the hearing. The court allowed it to the afternoon, but the report mistakenly stated morning, causing the overlap. I filed a motion to postpone to afternoon which was approved. I will attend this afternoon. Stop accusing me of harassment. She should talk to her lawyer about what happened. We fixed the problem. Such claims mislead the public and harm me personally. I might take further action because this never ends.”
What caused lawyer Tuy’s afternoon case?
“It relates to an incident outside courtroom 402 where she said I insulted her and my wife, gave media interviews, and her husband posted that I threatened them, which is untrue. The actual person insulting is her. Officials have verified the documents. Don’t lecture me on law; check documents carefully.”},{

“Yes, I have. Everyone has that legal right. But I use my rights honestly with real evidence when filing. False testimony should be careful; I will take legal action and show how it goes.”
