Regarding the case where "Ploy Chermarn Boonyasak" filed a lawsuit against "Note Chakriya Samutkiri" her former personal manager on charges of fraud related to the handling of her work payment funds,
before "Note" posted an update stating the court dismissed both the civil and criminal cases. He thanked the justice system, affirmed he did not commit the alleged wrongdoing, and concluded with the message, “There is only one truth.”
Recently, we met "Ploy Chermarn" at the LBC Grand Opening event launching a new branch at Future Park Rangsit, where she spoke openly for the first time about the issue, saying,
“This situation happened about two to three years ago. I never posted, spoke, or mentioned it because I wanted to keep it private or within the court. But after the court proceedings finished and Note posted his statement, I felt that
okay, he has the right to clarify. From my perspective and feelings, I just want to say that okay, he won in court. I accept the court’s decision and respect the court.
However, that doesn’t mean the court's dismissal means what Note did to me, Lydia, and my friends was correct, transparent, or honest. We have to differentiate facts. I will continue to fight in the appeal process and exercise my legal rights to appeal.”
About how many cases?
For my own, it's actually called 'cases,' right? I’m taking only one case because if I dig into everything, there would be many, but I’m tired. I just want to join the lawsuit with the others. For Lydia, there are about 30 cases, and together with Airin, about 70 cases. But so far, the court dismissed just my one case. I think people shouldn’t be too happy yet; this isn’t over.
Your case includes both criminal and civil, right?
“Yes, there are still many more. I just want to focus on this one case because what I found and experienced is real, it’s the truth. I understand if the court ruled this way, but we still have legal options to continue fighting.”
Because the court felt your evidence wasn’t strong enough? You seemed a bit disappointed.
“Yes, I was a bit sad and disappointed. But what could I do? No one would have expected this from him. I didn’t prepare or keep evidence or look for faults like he did. It’s different when one side is prepared and the other is not.”
What additional evidence will you submit in the appeal?
“I will have to gather clearer, more solid evidence.”
Have you started this process yet?
“Actually, my documents clearly show irregularities—let's say a lack of transparency and things I wasn’t aware of. So, that means something is wrong. But since the court ruled this way, we respect the court and will appeal and continue to fight.”
Did you get to meet during the court proceedings?
“Yes, we saw each other all the time.”
Did you talk? “No, we didn’t talk. But Note testified in court that he was just a broker and never a manager. He said I put his number on Instagram, but he never asked me to post it.”
Did it hurt? How did you feel?
“Yes, it hurt a lot. What he did—I felt very sad. I heard him say that in court, where lying is prohibited. I felt shocked, like a slap in the face, very hurt.”What was Note’s status when he worked with you?“Note worked for Lydia first. He was her backup dancer and was nurtured to become her manager because Lydia cared for him. Since it was like family, Lydia had Note take care of me because I took care of myself and they felt sorry for me. So Note came to look after me.
But there was no written contract defining him as my manager. It was a verbal agreement. I think I lost the case because of this point.”
But on your social media and others', he was listed as your manager?
“Yes, in practice everyone knows he was my manager, but the court did not recognize this because it looks at evidence. If I had a written manager contract, it would be stronger.”
After appealing, will there be any out-of-court settlement or discussion?
“Actually, Note’s lawyer asked for mediation three or four times, but we declined. I wondered how they knew to ask for mediation so often (laughs). But it’s okay; this is how it is, and we will keep fighting.”
What about the phrase “there is only one truth”?
“That’s Note’s phrase, and it’s true. That’s why I said yes, there is only one truth. What I and Lydia experienced is the truth, and it really is the one truth. But as I said, we still have to keep fighting.”
What are your expectations for the appeal?
“I really don’t know and have to respect the court. I don’t like going to court, but I must do it for justice. I can’t accept what he did to me, Lydia, and the team. There are many plaintiffs.
But those who go to court include me, Lydia, Airin, and several others who aren’t ready or can’t afford lawyers, so they let it go. There are many parties involved.”
The lower court ruled he was a broker, not a manager. Will you have a new legal strategy to gain advantage on appeal?
“I can’t say how we will fight now. I need to consult my lawyer first. If I say too much, he might sue me back and that would be bad (laughs).”
Has Noum Kanchai accepted the case for the 'Hon Krasae' show?
“I thank Noum very much. I’m a bit mischievous sometimes in how I end things.”
Will you go on the show?
“Definitely.”
When and how?
“I want to thank Noum first. I feel that if this issue is in his hands, it might be resolved more easily. The public can judge and listen, which could be easier than in court, or maybe the court will see it differently. But for now, it’s not appropriate to go on Noum’s show because Lydia and Airin’s cases are still in court. Going on the show could harm the case. So, we plan to wait until their cases finish, then we will definitely go together. Tell Noum to wait a bit.”
Will you bring Lydia with you?
“Yes, I will bring her and also Airin. ‘Star Dance’ (laughs).”
How is your mental state now? Have sadness, stress, and anger faded?
“It has been over three years since this came out. I was diagnosed with cancer, broke up, and then Note did this. Three big issues. I was very depressed and lost 13 kilograms. But now, I’m no longer stressed, I smile, have accepted it, and feel at peace. I feel most sorry for Lydia. I want to focus on just this one case, but she is the most unfortunate.”
Lydia’s case might be decided this year. Have you talked to or encouraged her?
“She’s fighting. She has about 30 cases and has been to court many times. I give her lots of support. She hopes the court will understand. My case is just one and might not be strong enough, but together with Airin and Lydia, there are about 70 cases still to fight.”
Do you have anything to say to him since he also agreed to appear on the show?
“Take care of yourself (smiles).”
