OIC Coordinates with Two Insurance Companies to Pay 1.65 Million Baht Compensation Per Death in Train-Bus Collision

Adisorn Pipatvorapong, Deputy Secretary-General for Legal Affairs and Inspection at the Office of Insurance Commission (OIC), revealed that a collision between a train and a public bus occurred at the Makkasan railway crossing on Asoke–Din Daeng Road between Rama 9 and Asoke Phet intersections in Makkasan Subdistrict, Ratchathewi District, Bangkok. The bus, registration 12-5641 Bangkok, crashed into an expressway pier, causing a severe fire.

The accident resulted in 8 deaths and 30 injuries. Additionally, 6 cars were damaged, 1 locomotive was damaged, and 5 motorcycles were damaged.

The OIC has coordinated with the relevant insurance companies to verify coverage under the policies and to facilitate insurance benefits closely for the injured and the deceased's heirs.

Initial checks found that the bus had insurance coverage with compensation to the deceased of about 1.65 million baht per person, as follows:

  • Compulsory motor insurance (Por Ror Bor) with Dhipaya Insurance Public Company Limited provides death compensation of 500,000 baht per person.
  • Voluntary insurance with Muang Thai Insurance Public Company Limited covers third-party liability with death compensation of 1 million baht per person.
  • An additional personal accident rider covers all passengers, providing death compensation of 150,000 baht per person.

Regarding the State Railway of Thailand (SRT), the OIC has not yet found any information on whether SRT has insurance coverage for this incident.

The OIC and the related insurance companies are fully supporting and assisting victims, proceeding with compensation payments, medical expenses, and assistance according to the insurance policies’ terms for the injured and the deceased's heirs as quickly as possible.

“At this stage, no determination has been made regarding fault. If it is found that both parties were negligent, both the Bangkok Mass Transit Authority (BMTA) and the railway would share responsibility proportionally under the law. This requires a court ruling, which takes time. Initially, the OIC has requested both insurers to pay full compensation to the deceased victims promptly to ensure thorough support. Both companies have agreed and are cooperating by paying compensation first. Determining fault or the degree of liability is a legal process that will take time,” Adisorn said.

Additionally, the OIC is investigating whether the victims have other insurance policies such as life insurance, personal accident insurance, or other relevant policies to ensure that victims and heirs receive full insurance benefits. If additional coverage is found, they will receive protection and compensation according to the policy terms and conditions.
