Legal Penalties for Reckless Driving Causing Injury or Property Damage

The Ministry of Justice revealed that reckless driving causing injury or property damage results in legal penalties including imprisonment and fines.

1. A standard car collision with no injuries or deaths.

This is an offense of reckless or dangerous driving, punishable by a fine of 400 to 1,000 baht (Land Traffic Act (No. 13) B.E. 2565 [2022], as amended, Sections 43(4) and 157).

2. A collision causing minor injuries.

This constitutes reckless driving causing bodily or mental harm to others, punishable by imprisonment up to 1 month, a fine up to 10,000 baht, or both (Criminal Code Section 390).

3. A collision causing severe injury, disability, loss of body part, or requiring treatment for more than 20 days.

This is reckless driving causing serious injury, punishable by imprisonment up to 3 years, a fine up to 60,000 baht, or both (Criminal Code Section 300).

4. A collision causing the death of the other party.

This is reckless driving causing death, punishable by imprisonment up to 10 years, a fine of 200,000 baht, or both (Criminal Code Section 291).

In addition to criminal penalties, offenders must also compensate victims civilly. Recklessness excludes intentional acts of hitting another party.
