Shoppers Rejoice: ETDA Orders E-Marketplaces to Enforce Strict Controls on Products Without TISI or FDA Certification Starting 31 Dec

ETDA announced new duties for e-marketplace platforms effective 31 Dec 2025, requiring them to take responsibility for product quality, ensuring products have TISI or FDA certification, and registering sellers on their platforms to enable tracking if buyer deception is detected.

Mr. Chaiyachana Mitraphan, Director of the Electronic Transactions Development Agency (ETDA), revealed that the Electronic Transactions Committee's announcement concerning additional measures for digital platform service providers in the goods marketplace category, as specified in Section 18 (2) of the Digital Platform Business Operation Act B.E. 2565 (2022), will take effect from 31 Dec 2025 onwards. This imposes further responsibilities on digital goods marketplace platforms under Section 18 (2), reflecting risks to financial and commercial security and potential public harm, recognizing the platform's key role in driving the country’s online commerce.

E-marketplace platforms are required to disclose detailed information about products and sellers to ensure users have sufficient information to make informed transactions. They must collect registration data using reliable systems and verify information credibility appropriately. They must also check that products for sale or advertisement meet standards under laws from the Thai Industrial Standards Institute (TISI) and the Food and Drug Administration (FDA), issuing warnings to remove, suspend, or block non-compliant products. Detailed product information and supporting documents related to TISI and FDA standards must be displayed. Additionally, platforms must implement notice and takedown processes and establish measures to care for and compensate affected consumers as appropriate.

“This announcement was developed after consultation and understanding with e-marketplace operators. Currently, e-marketplaces are the primary online sales channel and play an important role in building trust in online transactions. Compliance with this announcement is not merely legal adherence but an elevation of the platform’s role in creating a standardized, trustworthy, and safe online environment for consumers, thereby strengthening the overall sustainability of the online commerce system,” Mr. Chaiyachana stated.
