The Department of Business Development warns government and private sectors connected to business data from the department not to violate personal data rights after discovering individuals using corporate data from the department for commercial purposes and reprocessing it, selectively extracting names of directors and shareholders.of legal entities.They publish which companies these individuals serve as directors or shareholders.Even thoughthey have no authority to do so.This violates the PDPA.Penalties include imprisonment, fines, and administrative sanctions.
Mr. Poonphong Nainapakorn, Director-General of the Department of Business Development, revealed that the department has detected individuals requesting corporate data from the department or accessing linked data, selectively extracting names of directors or shareholders in legal entities.They use this data for commercial purposes.They also publish names indicating which companies these individuals are directors or shareholders of, and reprocess the data further, for example,by conductinganalysis, classification, aggregation, or creating new data sets. Such reprocessing of personal data, if done by persons without proper authority,must be addressed.As data controllers under the Personal Data Protection Act B.E. 2562 (PDPA), this constitutes unauthorized disclosure of shareholder and director personal data, violating PDPA rights. Such violations carry civil, criminal, and administrative penalties.
Currently, about 200 government agencies request business data from the department, and around 70 business users also request data for various purposes, such as developing customer information, analyzing and planning business strategies, registering legal entities for bank transactions, and conducting financial transactions like loan applications.
The department requests cooperation and warns government and business sectors accessing or requesting corporate data from the departmentto strictly complywith the Personal Data Protection Act.In the past, the department has issued warnings to business sectors that requested business data and published it citing the department's name. Disclosure of personal data requires prior consent from the data owner unless legally exempted. Otherwise, parties will be liable under civil, criminal, and administrative law.."
