Department of Intellectual Property Summons Applicant for NENE ROYAL Trademark Registration for Explanation to Prevent Misuse of Name

The Department of Intellectual Property has summoned the applicant seeking registration for the trademark "NENE ROYAL" to clarify the facts, emphasizing that any unauthorized and dishonest use of a famous person's name will result in immediate rejection of the application

The Department of Intellectual Property orders clarification regarding the "NENE ROYAL" registration

Following reports on social media about the use of artists' or celebrities' names for trademark registration, Ms. Jittima Sriporn, Director-General of the Department of Intellectual Property, stated that the department has verified the application for the trademark "NENE ROYAL" was indeed submitted electronically but remains in the initial stage of protection application, which does not mean the applicant automatically obtains rights to the trademark. It must undergo strict examination and consideration according to legal criteria. In this case, the registrar has ordered the applicant for the trademark "NENE ROYAL" to provide relevant information for clarification.

The law is clear: unauthorized use of famous names can be refused

If a famous person's name is used to apply for trademark registration without permission from the name owner, and the behavior constitutes unauthorized appropriation or exploitation of another's reputation dishonestly, the department may reject the trademark registration.

“During the application review, the registrar thoroughly examines facts and evidence, including the trademark's origin, the relationship between the applicant and the name owner, and proof of authorization to use the name. The registrar has authority under the Trademark Act B.E. 2534 and its amendments to summon the applicant for clarification or additional documentation to assess compliance with legal requirements, and has already requested the applicant to provide relevant information.”

Ms. Jittima of the Department of Intellectual Property affirmed that applications will be strictly and lawfully examined to prevent misuse of others' reputations for unfair gain, ensuring fair and transparent protection of name owners' rights and building trust in Thailand's trademark registration system. Citizens seeking advice or information on trademark registration and intellectual property protection can contact the IP Advisory Center (IPAC) hotline at 1368.
