Summary of Alcohol Beverage Control Laws: Prohibition on Selling Alcohol to Intoxicated Customers

On 18 Dec 2025 GMT+7, the Facebook fan pageCraft Beer Associationsummarized the alcohol beverage control law (a simple guide for retailers) that is currently in effect as follows:

1. Stores may sell alcohol from 11:00 to 24:00 hrs.

2. Stores are prohibited from selling to the following individuals:

  • Persons under 20 years old (sellers may request to see ID if there is doubt about the buyer’s age).
  • Persons who are intoxicated (sellers should assess the buyer's intoxication and may refuse sale if necessary).

The prohibition on selling to intoxicated persons is a new regulation under the Alcohol Beverage Control Act, Amendment No. 2, B.E. 2568 (2025). Section 29 states: "If a seller or store violates the prohibition on selling alcohol to intoxicated individuals, causing others to suffer harm such as property damage, injury, or death, the seller/store shall be jointly liable for compensation and subject to legal penalties."

Additional recommendations for stores to prevent violations include:

  • Installing CCTV inside the store to record evidence when necessary.
  • Educating staff about the law, the ability to identify prohibited persons, and the right to refuse sales.
  • Posting clear notices about the new law for customers.
  • Encouraging customers to use public transportation or ride-hailing services.
