
"Wittaya" questions the majority committee's ban on politicians drafting the constitution, threatens to seek interpretation from the Constitutional Court, and mocks that if they are this afraid, it would be better to do nothing.
On 10 Dec 2025 GMT+7, during the deliberation of the constitutional amendment draft, Article 256/3 concerning the qualifications of the Constitution Drafting Committee members, Mr. Wittaya Kaewparadai, party-list MP of the Ruam Thai Sang Chart Party, fiercely debated the conditions set by the majority committee. These prohibit individuals who were formerly politicians, ex-ministers, or ex-speakers of the house from applying as constitution drafters if less than five years have passed since leaving office. He questioned, "Why bar politicians from applying?" and warned that if clear qualification rulings are not made today, he will petition the Constitutional Court to interpret whether the law contains internal contradictions.
Mr. Wittaya ridiculed the condition as a "fear of off-topic issues," since ultimately the members selecting the drafters are parliamentarians elected under the existing constitution anyway. He added, "If that’s all you’re afraid of, then I suggest not amending at all and just stay put."
Meanwhile, Mr. Nattawut Buapathum, party-list MP of the Prachachon Party and chairman of the committee, explained that the condition is an "intent" initially set as an option, but he cannot act as a constitutional court judge to rule on legal matters at this time.
Nonetheless, the parliamentary session voted to approve the majority committee’s draft with 530 votes in favor, 30 against, 11 abstentions, and 5 not voting.
