18 Dec 2025 GMT+7 The Constitutional Court released documents after a case consultation meeting, including one concerning the Senate President's petition requesting the Constitutional Court to rule under Section 170, paragraph three, combined with Section 82 of the Constitution, on whether the ministerial status of Mr. Poomtham Vejchay, Deputy Prime Minister and Minister of Defence, and Police Colonel Tawee Sodsong, Minister of Justice, has ended individually under Section 170, paragraph one (4), combined with Section 160 (4) and (5) of the Constitution.
Senators signed the petition to the Senate President (the petitioner), alleging that both accused approved classifying certain criminal offenses as special cases under the Special Case Investigation Act B.E. 2547 (2004), amended, Section 21, paragraph one (2). This action was claimed to interfere with or dominate the Election Commission's duties by using the Department of Special Investigation as a tool to interfere in the Senate member selection review process, thereby harassing, pressuring, intimidating, and dominating senators, who are part of the legislative branch. This violates the separation of powers and the rule of law. Therefore, the two accused are considered to lack evident honesty and to have seriously violated or failed to comply with ethical standards under Sections 160 (4) and (5) of the Constitution, leading to the automatic termination of their ministerial status under Section 170, paragraph one (4), combined with Sections 160 (4) and (5).
Regarding the court's decision, the Constitutional Court deliberated to reach a ruling and scheduled a hearing with six witnesses on Wednesday, 24 December 2025, at 10:30 a.m., as originally planned. The witnesses include Police Major General Chatwat Saengphet, a senator; Mr. Poomtham Vejchay; Police Colonel Tawee Sodsong; Police Colonel Yuttana Praedam, Director-General of the Department of Special Investigation; Police Captain Surawut Rangsai, Deputy Director-General of the Department of Special Investigation; and Mr. Sa-ngueng Boonmee, Secretary-General of the Election Commission. .
