
There will be no advance voting for the constitutional amendment referendum. The yellow referendum ballot is to be used only on 8 Feb 2026. The Election Commission explained that campaigning must not involve offering, promising, deceiving, or coercing voters to exercise their rights.
On 15 Jan 2026, the Election Commission Office released guidelines on campaigning for the referendum in accordance with the Referendum Act of 2021 and its 2025 Amendment (No. 2) as follows.
1. Individuals, groups, or legal entities authorized to conduct campaigning related to the referendum.
1.1 Citizens, political parties, private organizations, and social groups (Section 17, Paragraph 1).
1.2 Government agencies (Section 17, Paragraph 2).
1.3 Radio and television broadcasting stations (Section 16, Paragraph 2).
2. The following actions are permitted.
2.1 Citizens, political parties, private organizations, and social groups can freely organize campaigning activities equally and fairly (Section 17, Paragraph 1).
2.2 Government agencies may organize informational activities about the referendum, allowing citizens, political parties, private organizations, and social groups to participate freely and equally (Section 17, Paragraph 2).
2.3 Broadcasting stations must provide equal opportunities for opinions on the referendum matter under the Broadcasting Act (Section 16, Paragraph 2).
3. The following actions are prohibited.
Referendum campaigning must not violate the Referendum Act of 2021 and its 2025 Amendment (No. 2) or related regulations, such as offering or promising incentives to discourage or influence voters to vote or abstain, deceiving, coercing, threatening voters to abstain or vote a certain way, or spreading false information about the referendum.
State officials assigned duties under the Referendum Act must not misuse their position, act improperly, neglect duties, or do anything that compromises the fairness and integrity of the voting process.
Since the Cabinet has set the referendum date to coincide with the general election, candidates and political parties must be cautious not to violate election laws related to the House of Representatives election.
Reporters note that voting for the referendum must take place on 8 Feb 2026 from 08:00 to 17:00 only; no advance voting is allowed. Similar to the House election, but voters can vote outside their registered district. The referendum ballot is yellow. It has options to approve or disapprove, asking the public “Do you approve that there should be a new constitution?”
