Supreme Court Orders 10-Year Election Disqualification for Wichian Chaisathaporn, Resulting in Senate Seat Vacancy

The Supreme Court ruled to revoke Wichian Chaisathaporn's eligibility to run for election for 10 years, resulting in his removal from the Senate seat after the Election Commission filed a petition alleging he misled others about his qualifications.


On 15 Jan 2026 GMT+7, reporters stated that Justice Kaimook Pophanichakorn of the Supreme Court signed a Supreme Court announcement regarding case number Lat Sa Wo 10/2568 (black number) and red number Lat Sa Wo 1/2569. The case was between the Election Commission as petitioner and Wichian Chaisathaporn as respondent, concerning the Act on the Acquisition of Members of the Senate (requesting revocation of election eligibility).

The Supreme Court ruled to revoke the election eligibility of respondent Wichian Chaisathaporn for a period of 10 years from the date of the judgment. This announcement is hereby made public on 14 January 2026 GMT+7.

Earlier, on 9 January, the Supreme Court's Election Case Division issued a ruling in a case where the Election Commission sued Wichian Chaisathaporn, a senator, for violations under the Act on the Acquisition of Members of the Senate B.E. 2561 (2018) section 62 and the Constitution of the Kingdom of Thailand B.E. 2560 (2017) section 226, requesting revocation of his election eligibility or voting rights.

The court found that the respondent stated in his candidate information form (Senate candidate form 3) that he was an “energy efficiency expert of the Ministry of Industry,” which was work experience unrelated to the group he was running for and was inaccurate. This could mislead voters or other candidates about his qualifications to secure votes unfairly, thus constituting electoral fraud that compromised the fairness and integrity of the Senate election. This ruling is pursuant to section 226 of the Constitution of the Kingdom of Thailand and section 62 of the Act on the Acquisition of Members of the Senate B.E. 2561 (2018). The court ordered the revocation of Wichian Chaisathaporn's election eligibility for a period of 10 years from the date of the judgment.

Reporters further noted that Wichian Chaisathaporn currently serves as a senator in Group 16, which covers arts, culture, music, performance, entertainment, and sports. Consequently, he must vacate his Senate seat, and the first reserve candidate on the list will be promoted to fill the vacancy.
