Supreme Court Orders 10-Year Election Ban for Wichian Chaisathaporn, Resulting in Loss of Senate Seat

The Supreme Court has issued a ruling to revoke Wichian Chaisathaporn's eligibility to run in elections for 10 years, resulting in his removal from the Senate after the Election Commission filed a petition alleging disqualifying characteristics and misleading others about his qualifications.


On 15 January 2026, reporters reported that Mrs. Kaimuk Popanichakorn, a Supreme Court judge, signed the Supreme Court's announcement stating that in election case number ลต สว 10/2568, red case number ลต สว 1/2569, between the Election Commission as petitioner and Mr. Wichian Chaisathaporn as respondent, regarding the Organic Act on the Election of Senators (request to revoke eligibility to run for election).

The Supreme Court has ruled to revoke the election candidacy rights of Mr. Wichian Chaisathaporn, the respondent, for a period of 10 years starting from the date of the verdict. This announcement is made public. Announced on 14 January 2026.

Additional reporting indicates that currently Mr. Wichian Chaisathaporn serves as a senator representing Group 16: Arts, Culture, Music, Performing Arts, Entertainment, and Sports. This ruling results in his removal from the Senate, and the first alternate on the reserve list will be promoted to replace him.

The case originated when the Election Commission received a complaint that Mr. Wichian Chaisathaporn, a national-level eligible candidate for Group 16, number 109, the respondent, committed acts violating the Organic Act on the Election of Senators B.E. 2561 (2018) as follows.

Allegation 1: The respondent knowingly applied to run for senator despite having disqualifying characteristics forbidding him from candidacy because he had been finally convicted of offenses under gambling laws as a gambling den operator and under anti-money laundering laws for money laundering. This violated Sections 14(12) and 74 of the Organic Act on the Election of Senators B.E. 2561.

Allegation 2: The respondent deceived or induced others to misunderstand the qualifications, knowledge, or abilities, or bought votes or the reputation of any candidate to persuade voters or candidates to vote for or against any person, violating Section 77(4) of the Organic Act on the Election of Senators B.E. 2561.

After consideration and investigation, the Election Commission ordered a petition be filed with the Supreme Court to revoke Mr. Wichian Chaisathaporn's right to run for election or to vote.

This is pursuant to Section 62 of the Organic Act on the Election of Senators B.E. 2561 and Section 226 of the Constitution of the Kingdom of Thailand B.E. 2560 (2017). Additionally, criminal proceedings were ordered against Mr. Wichian under Section 77(4) of the Organic Act on the Election of Senators for allegation 2, point 3, while allegations 1 and 2, points 1 and 2, were dismissed.
