Constitutional Court Orders Additional Input from Defense Minister on Netiwit Military Service Law Case

The Constitutional Court has ordered the Defense Minister to provide additional opinions and documents within 15 days regarding the case where Netiwit submitted a petition to rule on the Military Service Act.


On 28 January 2026, the Constitutional Court held a consultation on an important and noteworthy case, number 28/2568, concerning whether Sections 27 and 45 of the Military Service Act B.E. 2497 (1954) conflict with Articles 26 and 31 of the Constitution. The Samut Prakan Provincial Court sent the defendant's (Mr. Netiwit Chotiphatphaisal, an activist and political and social campaigner) objection in case number A 3118/2568, requesting the Constitutional Court to rule under Article 212 of the Constitution on whether Sections 27 and 45 of the Military Service Act conflict with Articles 26 and 31 of the Constitution.

Recently, after deliberation, the Constitutional Court decided that for the benefit of the case, it will request follow-up opinions and documentary evidence from the Defense Minister, who had been previously summoned. Relevant agencies or persons are also instructed to prepare opinions and submit copies of documents as specified by the court within 15 days of receiving the order to assist the Constitutional Court's ruling.
