This follows the EC's admission that barcodes on ballots can track voters' identities. She also plans to petition the Constitutional Court and the Supreme Court's Election Case Division to rule for a new election due to constitutional violations.
On 13 Feb 2026 GMT+7, Khunying Sudarat Keyuraphan, leader of the Thai Sang Thai Party, announced plans to take legal action against the Election Commission (EC) after the EC acknowledged that both barcodes and QR codes on ballots can be scanned and traced back to identify which voter selected which party or candidate. This conduct deliberately violates the fundamental principle of secret ballots. Khunying Sudarat pointed out that the EC's claim of separating ballots from the stub and keeping them confidential is unconvincing and fails to build public trust, especially since the recent election was rife with suspicious activities and fraud without accountability.
The legal action will be divided into two main parts to maximize legal effect. The first part targets individuals by filing charges against the EC at the Central Criminal Court for Corruption and Misconduct under Section 157 of the Penal Code, accusing them of misconduct or neglect of duty causing harm, or corruptly performing or neglecting duties, punishable by imprisonment. This is because the EC was fully aware that embedding identifiable codes on ballots clearly violates the law and constitution.
The second part aims to restore fairness to voters' ballots by filing petitions with the Constitutional Court and the Supreme Court’s Election Case Division, arguing that this election violated Article 85 of the Constitution and Section 96 of the Organic Act on the Election of Members of the House of Representatives, which protect voter secrecy and rights. This seeks to order a new, more transparent, and fair election. Meanwhile, the public and allied groups are invited to submit information, evidence, photos, or videos showing election irregularities to Khunying Sudarat’s page or the Thai Sang Thai Party page to support the legal process and reclaim sovereign power distorted by these violations.
