Pol. Col. Tawee supports citizens exercising their legal rights after filing a lawsuit against the Election Commission with the Supreme Administrative Court, expressing confidence that justice will prevail. He pointed out that anyone who compromises the secrecy of elections is eroding and undermining the democratic system headed by the monarchy.
At 12:16 p.m. on 16 Feb 2026 GMT+7, Pol. Col. Tawee Sodsong, leader of the Prachachart Party, postedon Facebookstating that "Anyone who compromises the secrecy of elections is committing an act that is corroding and undermining the democratic system under the monarchy and severely damaging the rule of law."
Pol. Col. Tawee further explained that sovereignty belongs to the Thai people. The election of members of the House of Representatives is the mechanism through which the people grant authority to their representatives to perform legislative duties under the constitution, which clearly states in Articles 3, 83, and 85 that voting must be direct and secret to protect the freedom and dignity of every citizen.
In the case where citizens have filed a complaint with the Supreme Administrative Court against the Election Commission and others, raising legal issues under the Organic Act on the Election of Members of the House of Representatives B.E. 2561 (2018) and its amendments—such as Article 96 prohibiting making marks for identification on ballots, Article 144 regarding spoilt ballots, as well as Articles 23, 149, and 164, along with the Election Commission Regulations B.E. 2566 (2023), Clauses 129 and 174 (2) (7)—these constitute significant legal questions for the court to carefully examine regarding whether such ballots should be considered spoilt and invalid for counting.
"I support the public’s use of legal rights to scrutinize the exercise of state power because oversight is the heart of the rule of law. If elections cause the public to feel that the secrecy of voting may be compromised for any reason, this must be taken seriously to protect confidence in the electoral system and the democratic regime."
The Prachachart Party stands firmly alongside citizens who exercise their rights in good faith. We believe that truth and justice will emerge through the judicial process, and we hope all parties will work together to uphold the sanctity of the people's votes so that elections continue to be a place of hope, trust, and fairness in Thai society.
