
Mongkolkit petitioned the Ombudsman to refer to the Constitutional Court the annulment of the 2026 election, citing that the Election Commission’s order to re-run elections in three polling stations violates the constitution. He compared this to the 2014 election, which was held twice after the PDRC closed polling stations. He urged Sarawong to disclose the Terms of Reference (TOR) for the ballots, specifically whether barcodes were printed on them.
On 18 Feb 2026 at 10:30 AM at the Election Commission (EC) office, Mongkolkit Suksintharanon, a party-list MP candidate and prime ministerial candidate for the New Alternative Party, held a press conference. He said that earlier that morning, he submitted a letter to the Ombudsman requesting an investigation into incomplete election management at some polling stations. He cited the 2014 election when the PDRC blocked two types of polling stations: 1) those where candidacy was not possible, and 2) those where candidacy was possible but voting was not. The Constitutional Court ruled that election null due to violation of the 2017 constitution, as two elections occurred simultaneously, undermining fairness and transparency. The public already knew the winner. The EC could only recount votes but could not declare those polling stations’ elections void and order new votes.
Mongkolkit said that currently, the EC has ordered re-elections in Bangkok’s District 15 Polling Station 9, Nan Province District 1 Polling Station 3, Udon Thani Province District 6 Polling Station 4, and recently added one more polling station. While ordering re-elections is possible, it violates the constitution. Therefore, to avoid nullifying this election, these three polling stations should not have re-elections ordered but rather a vote recount. However, since the EC has already ordered re-elections, this immediately violates the constitution, rendering the election null.
“Additionally, within one to two days, I will file a petition with the Administrative Court concerning the election process, which is direct but not secret. Overseas advance voting has been livestreamed, and ballots are sent by mail and through multiple agencies. This compromises the secrecy of overseas ballots. The EC has issued regulations beyond its authority, which is unconstitutional,” Mongkolkit said.
Mongkolkit also spoke about the procurement (TOR) of election ballots, saying that Sarawong Bunmee, EC Secretary-General, handled all direct procurements. He should disclose whether the TOR specifies printing barcodes on ballots so the public can be informed. If the Constitutional Court rules that these ballots do not allow direct and secret voting, Sarawong could be held accountable. Therefore, he urged Sarawong to take care of his health.
