Professor Jes Warns Election Commission Risks Legal Violations, Potentially Invalidating Election Demands Explanation on Ballot Discrepancies

Professor Jes, Rakchat Party’s prime ministerial candidate, warns the Election Commission of Thailand about the risk of legal violations that could invalidate the election, demanding clear answers on why the ballots are not uniform.

On 23 February 2026, Jes Tonawanik, Rakchat Party’s prime ministerial candidate, spoke about the Election Commission of Thailand’s management of the election, which has been full of suspicions and sudden changes—especially regarding the “ballots.” He criticized the Commission’s lack of clear explanations, noting that this Commission seems unusually “diligent” in adjusting details such as ballot formats, yet fails to properly explain these changes to the public. He said it would have been simple if they had initially clarified how many ballot types there are, their green and pink colors, their appearance, and the purpose of each type. For example, what is the yellow referendum ballot for? Now they have changed the ballots again, yet they seemingly did not consider why they must explain the purpose of QR barcodes on the ballots.

Jes pointed out the legal risks if the Election Commission cannot clear doubts about violations of citizens’ rights and freedoms. This could lead to lawsuits seeking to annul the entire election, causing massive damage—not only affecting by-elections in some areas but potentially dismantling the entire electoral system that has been established.

Jes questioned where the previous explanations have gone, saying that people have already filed complaints claiming their rights and freedoms were violated, which could invalidate the election. He noted that recounts in some precincts still face problems. If the Commission orders a new election, but manages it in the same problematic way, it would undo all previous work because the explanations are inconsistent. He added that no one wants to punish the Commission, but if they continue in this manner, it could amount to dereliction of duty or misconduct, which could lead to legal consequences.

Jes urged the Election Commission to provide clear answers in a way even children can understand, to help the country move out of its rotten political quagmire and toward an internationally recognized election. He said, “Start with the simplest matter: please explain why the ballots are different. The Commission or its Secretary-General must explain this. If they cannot, this is no longer a new election—the entire original election will be invalidated. Please provide a clear explanation.”
