Srisuwan Files Complaint with Pathum Thani Election Commission Over Candidates Post-Election Gift Distribution

Srisuwan submitted a complaint to the Pathum Thani Election Commission urging an investigation into whether a People’s Party candidate in Constituency 8 distributing gifts after the election violated the law. He emphasized that if the investigation confirms the facts, the Election Commission should refer the case to the Supreme Court for penalty consideration.

At 09:30 on 24 Feb 2026 GMT+7, Mr. Srisuwan Janya, leader of the Patriotic Organization, came to file a complaint at the Pathum Thani Provincial Election Commission Office through the provincial election director to report a tip for investigation or inquiry regarding a candidate for the House of Representatives from the People’s Party in Pathum Thani Constituency 8, who distributed drinks and campaign T-shirts to thank voters in the constituency, possibly violating Section 73 (1) of the 2018 Organic Act on Election of Members of the House of Representatives.

This follows a candidate from Pathum Thani Constituency 8 of the People’s Party posting on their personal Facebook page about a week after the election. The post included messages and photos of themselves and their team during field visits at that time, stating: “Today, I met with the people of Pathum Thani Constituency 8 to personally thank them for every vote they gave me. I also presented team Mike’s T-shirts as a token of heartfelt gratitude. The support given has never depended on position or election outcome but reflects the determination of me and my team...”

Mr. Srisuwan further noted that the Facebook page showed photos of the candidate distributing boxes of drinks and orange T-shirts bearing the People’s Party logo and candidate number 6 — the candidate’s official election number from the 8 Feb 2026 election — to many smiling citizens. This serves as important evidence indicating the candidate’s intent to violate the 2018 Organic Act on Election of Members of the House of Representatives, as amended. Section 73 (1) prohibits candidates or anyone from doing anything to induce voters to vote for themselves or others, abstain from voting, or encourage not voting for any candidate by offering, promising, or preparing to give money or any other benefits that can be valued in monetary terms.

“If the Election Commission’s investigative or inquiry team confirms these facts, the case should be forwarded to the Election Commission to submit to the Supreme Court for penalty consideration against the candidate under Section 158. Penalties include imprisonment from 1 to 10 years, fines from 20,000 to 200,000 baht, or both, along with a 20-year revocation of voting rights. Furthermore, if investigations find that the party leader or the People’s Party executive committee was aware of or neglected to prevent this act, failing to ensure a fair election, the Election Commission must file a petition to the Constitutional Court to dissolve the party and revoke the political rights of its executives under Section 132, paragraph three.”

At the end, Mr. Srisuwan stressed that although the photos and messages have since been deleted from the page, he had already captured and saved all the images and messages, confirming that the act took place and constitutes a completed offense. The Patriotic Organization therefore submitted this tip to the Pathum Thani Election Commission for action according to legal authority and procedures.
