Democrat Party Issues Statement Urging Election Commission to Cease Legal Action Against Election Observers

The Democrat Party issued a statement urging the Election Commission to stop filing lawsuits against citizens who scrutinize the election, pointing out that the charges are excessively harsh and recommending using explanations and transparency to confirm fairness.

On 27 February 2026, the Democrat Party released a statement requesting the Election Commission to reconsider its stance and actions regarding the examination of the election management, following news that the commission authorized its deputy secretary-general to file a complaint with the Crime Suppression Division to prosecute a group of individuals who jointly inspected concerns about barcodes on ballots on 22 February.

The Democrat Party strongly disagrees with the Election Commission's actions because the 8 February election contained numerous errors and questionable procedures. These include the barcode issue on ballots, which had confusing and contradictory explanations that escalated into legal and constitutional problems, prompting complaints to the Administrative Court and the Ombudsman, and eventually bringing the matter to the Constitutional Court. Other issues include ballot discrepancies, suspicious disposal of important documents at polling stations, officials tearing and marking ballots themselves, mismatches between tally counts and marked score sheets, and questionable markings on scoreboards. In all cases, explanations have been unclear, and requests for disclosure of information have been denied, raising doubts about the election's integrity and fairness in the wider society.

Therefore, individuals seeking to investigate matters they doubt, using methods that do not obstruct or interfere with officials' duties, have a rightful legal and constitutional entitlement to do so. Responding to such investigations by suing those inspecting the process is therefore an excessive measure, implying lawsuits aimed at silencing the public, which contradicts the principles of transparency fundamental to a genuine democracy.

Moreover, the charges brought forward are severe, including accusations of gang involvement, election obstruction, disclosing information, and inserting false data into computer systems. These seem inconsistent with public footage showing that the inspections were conducted openly without threatening or obstructing officials carrying out their duties.

The Democrat Party calls on the Election Commission to cease such actions and instead engage in public explanations and disclose information openly to confirm transparency in the process, thereby preserving the dignity of this key institution within Thailand’s democratic system.
