Government Increases Compensation for Victims and Defendants Acquitted in Criminal Cases Up to 300,000 Baht, Effective Immediately

The Deputy Government Spokesperson revealed that the government has increased compensation for "victims and defendants in criminal cases acquitted by the court" up to 300,000 baht, ensuring appropriate relief aligned with the economic situation. The change is now in effect.

On 4 March 2026, Ms. Lalida Pertwivatana, Deputy Spokesperson of the Prime Minister's Office, stated that the Royal Gazette published a ministerial regulation under the Compensation Act for Victims and Reimbursement and Expenses for Defendants in Criminal Cases B.E. 2544 (2001), effective from 3 March 2026 onward. This regulation raises compensation rates to align with current economic and social conditions.

The Deputy Spokesperson explained that this update enhances the protection of citizens' rights for both "victims" in criminal cases and "defendants" who are later acquitted or found not guilty by the court, providing them with more appropriate compensation. The key points in raising the compensation ceiling for victims are as follows.

In cases where the victim has died,

the compensation has been increased from the previous 30,000–100,000 baht to a maximum of 300,000 baht, encompassing all related expenses within this single amount.

In cases where the victim survives,

medical treatment costs have been increased to a maximum of 80,000 baht (paid as incurred).

Rehabilitation for physical and mental recovery has been increased to a maximum of 50,000 baht.

Other damages to body or mind have been increased to a maximum of 100,000 baht.

A new rate has been set for loss of organs or disability, with a maximum of 300,000 baht.

Protections for defendants who suffer damages from prosecution (in cases of acquittal) have been enhanced. In cases where the defendant dies due to prosecution,

the compensation ceiling has been raised to a maximum of 300,000 baht.

In cases where the defendant survives,

medical treatment costs have been increased to a maximum of 80,000 baht (paid as incurred).

Rehabilitation for physical and mental recovery is capped at 50,000 baht.

Legal expenses related to the case are capped at 30,000 baht.

Ms. Lalida said these measures will ensure fairer assistance reflecting actual damages, reduce unnecessary procedures, and improve efficiency in consideration so that the public receives compensation promptly and effectively.
