Administrative Court Reveals 18 Hot Cases Suing Election Commission Over Election and Referendum Issues

The Election Commission faces serious difficulties as the Administrative Court disclosed 18 lawsuits across 8 issues. The court stressed it reviews only election management procedures, while voter disqualification cases are the responsibility of the Supreme Court.


On 6 March at the Supreme Administrative Court building, Mr. Prawit Boontiam, Deputy President of the Supreme Administrative Court and Chair of its Public Relations Committee, reported on the progress of cases concerning the election and referendum under review. He stated there are currently 18 lawsuits against the EC covering 8 main issues, such as barcode issues on ballots, ballot irregularities, unlawful merging of polling stations, and allegations of unfair election management.

Mr. Prawit revealed the latest rulings: the Central Administrative Court has dismissed one case regarding registration to vote in the referendum outside the electoral district three days late, which is currently under appeal. Additionally, the court rejected two cases—one concerning the use of the term "approved" in the referendum, and another about the referendum ballot that forces voters to mark only "approve" or "disapprove." There is also one case withdrawn by the plaintiff involving the claim that holding the referendum on the same day as the election was unlawful.

Mr. Prawit emphasized that the Administrative Court has jurisdiction only over election procedure matters. Issues involving voter disqualification or candidate qualifications under the 2018 MPs Election Act fall under the jurisdiction of the Supreme Court's Election Case Division.
