Constitutional Court Accepts Petition on 400 Billion Baht Loan Decree, Orders Cabinet to Respond Within 7 Days

The Constitutional Court has ordered acceptance of the petition concerning the “400 billion baht loan decree,” instructing the Cabinet to provide explanations on the specified issues and submit relevant evidence to the court within seven days from receiving the letter.


On 18 May 2026 GMT+7, the office of the Constitutional Court published consideration case number 11/2569 regarding a petition submitted by 133 Members of Parliament (MPs), constituting no less than one-fifth of the total members of the House of Representatives, who jointly presented their opinion to the Speaker of the House (the petitioner) stating that the Royal Decree granting the Ministry of Finance authority to borrow funds to address the impacts of the energy crisis and facilitate the country’s energy transition, B.E. 2569 (2026), ( the 400 billion baht loan decree ) is not in accordance with Article 172, paragraph one of the Constitution. The petitioner thus requested the Constitutional Court to adjudicate in accordance with Article 173, paragraph one of the Constitution.

Upon reviewing the facts and accompanying documents, the Constitutional Court found the case falls under Article 173, paragraph one of the Constitution, together with Section 7(1) of the Organic Act on the Constitutional Court Procedure B.E. 2561 (2018), and therefore ordered acceptance of the petition for adjudication. The court notified the petitioner and, for the benefit of the proceedings, under the authority of Section 27, paragraph three of the Organic Act on the Constitutional Court Procedure B.E. 2561 (2018), ordered the Cabinet to submit explanations on the issues determined by the court and provide copies of related evidence to the Constitutional Court within seven days from the date of receipt of the letter. .
