Cabinet Assigns Agencies to Prepare Urgent Explanation and Documents on Loan Decree for Constitutional Court

The Cabinet acknowledged the parliament's referral of the 400-billion-baht loan decree to the Constitutional Court for review regarding the energy crisis, and assigned relevant agencies to urgently prepare explanations and documents before forwarding them to the Secretariat of the Cabinet for further procedures.


19 May 2026 GMT+7 Ms. Ratchada Thanadirek, spokesperson for the Office of the Prime Minister, announced that the Cabinet meeting acknowledged the submission by the Speaker of the House of Representatives of a joint opinion from 133 Members of Parliament. They exercised their rights under Section 173, Paragraph One of the Constitution to request the Speaker to forward their opinion to the Constitutional Court, seeking a ruling on whether the Royal Decree authorizing the Ministry of Finance to borrow funds to address impacts from the energy crisis and to drive the country’s energy transition in 2026 ( the 400-billion-baht loan decree ) violates Section 172, Paragraph One of the Constitution.

Furthermore, the Cabinet assigned the Ministry of Finance, the Budget Bureau, the National Economic and Social Development Council, and relevant agencies, in collaboration with the Office of the Council of State, to urgently prepare explanations and supporting documents on the matter. These are to be submitted to the Secretariat of the Cabinet to prepare responses for the Constitutional Court. .
