Constitutional Court Awaits Opinions and Documents in 400 Billion Baht Loan Decree Case

The Constitutional Court has ordered to await opinions and documents from relevant parties previously summoned concerning the 400 billion baht loan decree case, involving 133 MPs who jointly requested a constitutional ruling.


On 10 Jun 2026 GMT+7, the Constitutional Court considered the case brought by 133 members of the House of Representatives—representing not less than one-fifth of the total membership—who jointly submitted a petition to the Speaker. They claimed that the Emergency Decree granting the Ministry of Finance authority to borrow money to address the impacts of the energy crisis and to facilitate the country's energy transition, B.E. 2569 (2026), violated Section 172, Paragraph One of the Constitution. The petition was submitted for the Constitutional Court's consideration under Section 173, Paragraph One of the Constitution.

The Court stated that, for the benefit of the case’s consideration, it will await opinions and evidence from the individuals involved, whom the Constitutional Court had previously summoned.
