Constitutional Court to Vote on July 9 on Whether 400 Billion Baht Loan Decree Violates Constitution

The Constitutional Court is scheduled to rule on July 9 on whether the 400 billion baht loan decree to address the energy crisis violates Section 172, Paragraph 1 of the Constitution.


On 24 June 2026, the Constitutional Court debated to reach a decision in a case where 133 members of the House of Representatives—no fewer than one-fifth of the total members—jointly petitioned the Speaker of the House. They claimed that the emergency decree authorizing the Ministry of Finance to borrow funds to resolve impacts from the energy crisis and facilitate the country's energy transition in 2026 violated Section 172, Paragraph 1 of the Constitution. The petition was submitted to the Constitutional Court for review under Section 173, Paragraph 1 of the Constitution. The Court determined the case involved legal questions and had sufficient evidence for judgment, thus suspending further investigation according to Section 58, Paragraph 1 of the Constitutional Court Procedure Act B.E. 2561 (2018). The Court scheduled an oral hearing, deliberation, and vote for Thursday, 9 July 2026, at 9:00 a.m.


According to Section 173, Paragraph 2 of the Constitution, the Constitutional Court must issue its ruling within 60 days from the date it receives the case.
