This follows reports and opinions circulated in the media and social networks about a Member of Parliament who claimed ineligibility to vote for a Bangkok Council member after moving their household registration to a new electoral district less than one year ago, suggesting that Election Commission regulations caused this restriction.
The Election Commission Office clarifies the relevant legal provisions and criteria as follows:
1. The Local Council or Local Executive Election Act B.E. 2562 (2019), as amended, Section 38, requires voters to have their name registered in the household registry within the electoral district for at least one year as of election day. If a voter moves their household registration within the same local administrative organization and has been in the new electoral district for less than one year, they retain the right to vote for the local council member in their previous electoral district where their name has been registered continuously for at least one year.
2. The Election Commission's regulations on the election of local council members or local executives B.E. 2562 (2019), as amended, Article 78, stipulate the exercise of this right. Voters who move their household registration from one electoral district to another within the same local administrative organization under Section 38, paragraph two of the Local Council or Local Executive Election Act B.E. 2562 (2019), are entitled to vote in the polling station where they were last registered continuously for at least one year.
In cases where a local administrative organization holds an election solely for a local executive or simultaneously for both local council members and executives, the individual is entitled to vote for the local executive in the electoral district where they are registered, and for the local council member in the electoral district where their name has been continuously registered in the household registry for at least one year.
Voters must submit a request to add their name to the voter list (Form ส.ถ./ผ.ถ. 1/7) to the district registrar or local registrar in their electoral district at least 10 days before the election. The Election Commission requests cooperation from all sectors to disseminate election information based on factual and legal provisions to ensure the public receives accurate, complete information and to prevent confusion.
