The government is inviting public opinions on the new draft surrogacy law, encouraging people to share feedback through the legal central system at www.law.go.th until 31 July, aiming to prevent human trafficking and exploitation.
On 19 July 2026 GMT+7, Ms. Ploytale Laksamisaengchan, Deputy Spokesperson of the Prime Minister's Office, stated that Thailand is becoming an aging society with a rising trend of infertility. Meanwhile, fertility technologies are advancing and increasingly utilized. Therefore, it is necessary to revise laws to suit current social contexts, related legislation, and international standards.
Ms. Ploytale said the government, through the Department of Health Service Support, Ministry of Public Health, prioritizes updating laws to reflect the current situation, especially regarding medical fertility technologies (surrogacy), which continue to develop. This legal revision aims to balance promoting access to medical technology with protecting the rights and welfare of children, service users, surrogate mothers, and medical personnel. It also seeks to enhance regulatory efficiency, prevent commercial exploitation and human trafficking, and support the country's development as a Medical Hub under stringent, transparent, and internationally accepted laws.
"The key points of the revised draft law include changing the term 'husband and wife' to 'spouses' to align with other laws and allow equal access for all spouses; increasing officials to improve law enforcement efficiency; adjusting conditions for services involving foreign spouses; permitting owners of sperm, eggs, or embryos to export them under specified legal conditions; and raising penalties for offenses to prevent and suppress human trafficking and exploitation," Ms. Ploytale emphasized.
