The government spokesperson revealed that the Cabinet approved amendments to four capital market laws to support the adoption of appropriate technology in various transactions, laying the foundation for a transparent and credible Thai capital market.
On 25 Aug 2026 GMT+7, Ms. Ratchada Thanadirek, spokesperson for the Prime Minister's Office, stated that the government’s policy is to develop the capital market system as a key mechanism to support the country's growth. The capital market serves as a funding channel for businesses and an investment and savings option for the public. Therefore, today's Cabinet meeting approved, as proposed by the Ministry of Finance, amendments to laws that support the use of appropriate technology in capital market transactions, clarify regulatory oversight, and enhance law enforcement efficiency across four laws as follows.
1. Draft Amendment to the Securities and Exchange Act (No. ..) B.E. ....
2. Draft Amendment to the Futures Contract Act (No. ..) B.E. ....
3. Draft Amendment to the Trust for Transactions in the Capital Market Act (No. ..) B.E. ....
4. Draft Amendment to the Digital Asset Business Act of 2018 (B.E. 2561) B.E. ....
Ms. Ratchada said these capital market law amendments aim to elevate the Thai capital market in three key dimensions: (1) enhancing efficiency and modernization to better support electronic processes; (2) boosting investor confidence through more effective regulation and enforcement; and (3) improving supervision of fundraising and related market participants (business operators, secondary markets, related organizations, and service providers). This lays a foundation for a credible, transparent, and competitive Thai capital market aligned with government policy to develop the economy and capital market into a vital growth engine and meet international standards to support the future digital economy.
Ms. Ratchada added that the main points of the four capital market draft laws are as follows.
1. Draft Amendment to the Securities and Exchange Act (No. ..) B.E. .... Key points include: 1) Enhancing technology regulation by overseeing service providers critical to the capital market’s digital infrastructure and clarifying legal validity for electronic submission, receipt, advertising, announcements, and documentation; 2) Strengthening gatekeeper oversight, covering auditors and audit firms, financial advisors, asset valuers, credit rating agencies both domestic and foreign, and securities business personnel, enabling direct supervision throughout the gatekeeper chain; 3) Empowering SEC officials to jointly investigate high-impact cases with law enforcement or special case investigators and restructuring penalties to administrative fines proportionate to offense severity.
2. Draft Amendment to the Futures Contract Act (No. ..) B.E. .... Key points include: 1) Supporting electronic processes for submission, receipt, advertising, announcements, and documentation more clearly; 2) Increasing joint investigative powers for SEC officials to work with law enforcement or special case investigators on high-impact cases.
3. Draft Amendment to the Trust for Transactions in the Capital Market Act (No. ..) B.E. .... Key points include supporting electronic processes for submission, receipt, advertising, announcements, and documentation more clearly to facilitate convenience, reduce burdens, and shorten processing time for the public and businesses.
4. Draft Amendment to the Digital Asset Business Act of 2018 (B.E. 2561) B.E. .... Key points include increasing joint investigative authority for SEC officials to work with law enforcement or special case investigators on high-impact cases, aiming to expedite, streamline, and improve the completeness of pre-prosecution processes.
