The Constitutional Court unanimously dismissed the petition against the Prime Minister, Senate President, and others for allowing Dr. Sorn to serve as chairman of the NBTC, ruling that no rights were violated and the case did not meet the conditions of Section 213.
On 10 Sep 2026 GMT+7, the Constitutional Court unanimously ordered not to accept the petition for consideration in the case filed by Mr. Metha Maskhao, Acting Secretary-General of the Campaign Committee for Democracy (CCD), requesting the court to adjudicate under Constitutional Section 213.
The petitioner claimed that Professor Clinician Dr. Sorn Boonbaichaiyapruck, chairman of the NBTC (respondent 1); Mr. Trirat Viriyasirikul, Acting Secretary-General of the NBTC (respondent 2); Mr. Anutin Charnvirakul, Prime Minister (respondent 3); Ms. Paethongtarn Shinawatra, former Prime Minister (respondent 4); former Secretary-General of the Senate (respondent 5); current Secretary-General of the Senate (respondent 6); and the Senate President (respondent 7) collectively neglected to act according to the law, allowing Dr. Sorn to continue serving as NBTC chairman in violation of the Frequency Allocation and Broadcasting Act B.E. 2553 (2010), Sections 18 and 20, conflicting with Constitutional Sections 3 paragraph two, 6, 180, and 182, thereby infringing on the petitioner’s rights or freedoms through misuse of state power.
The court found that the facts and supporting documents did not show that Mr. Metha, the petitioner, was directly infringed in his rights or freedoms nor suffered harm or damage from the actions of all seven respondents. The case did not comply with the criteria, procedures, and conditions under the Constitutional Court Procedure Act 2018, Section 46, paragraph one. Therefore, Mr. Metha cannot file such a petition under Constitutional Section 213.
