Lawyer Aun stormed the Election Commission, demanding it send the Senate election case to the Constitutional Court to declare it null and void, pointing out that ballot preparation violated the constitution and criticizing the Election Commission chairman for dismissing witnesses.
On 16 Sep 2026 GMT+7, Mr. Phattharaphong Suphakorn, known as "Lawyer Aun," submitted a letter to the chairman of the Election Commission (EC) requesting that the matter be referred to the Constitutional Court to decide whether the Senate election complies with the constitution and whether the election should be declared void. He stated that the conduct of ballot preparation and prosecution of individuals involved constitute clear evidence that the Senate election process violated Article 107 of the constitution and Article 33 of the Act on the Acquisition of Senators, which mandates that voting must be secret, independent, and free from coercion.
He argued that since the process lacked honesty and independence, the entire election must be nullified. Additionally, Mr. Phattharaphong presented a bouquet to encourage the two minority Election Commission members, Mr. Sitthichot Intrawiset and Mr. Chai Nakornchai.
Mr. Phattharaphong criticized the EC chairman for dismissing evidence in the Senate vote-rigging case based solely on three witnesses retracting their statements. He said this was a misuse of legal principles because weighing evidence as in criminal cases—requiring no reasonable doubt—applies only before official certification of results. Once the EC certifies the Senate positions, it must follow Article 62, which mandates that if there is credible evidence of dishonest or unfair conduct, the EC must immediately forward the case to the court for a ruling and cannot unilaterally dismiss or cancel the case file.
