Reserve senators urge the Election Commission to cancel the 5-2 resolution and stop referring the case to the Constitutional Court for interpretation of the Supreme Court's authority, accusing it of delaying for nearly two years to whitewash allies involved in Senate election collusion.
On 3 Nov 2026 GMT+7, at the Election Commission (EC) office, a group of reserve senators led by Mr. Akarawut Pongthanachalitkul submitted a letter to the EC and held a press conference, calling on the EC to reconsider and cancel the 5-2 majority decision to refer the matter to the Constitutional Court to rule on the authority to assess qualifications and elect Senate members.
Representatives of the reserve senators revealed that the 2024 Senate election corruption and collusion case has dragged on for over two years, yet the EC's actions remain unclear. Recently, the EC is attempting to delay by claiming that the authority to certify Senate candidate qualifications at district, provincial, and central EC levels is final, and plans to request the Constitutional Court to interpret that the Supreme Court's election division has no jurisdiction to accept petitions.
"Such behavior is a delay tactic, trying to use the Constitutional Court to undermine the Supreme Court’s authority to whitewash allies, copying past cases of asset concealment. According to Section 62, when the EC has reasonable grounds to believe a violation occurred, it must send the case to the Supreme Court’s election division, the pillar respected and trusted by the public," said the reserve senators' representative.
The reserve senators' representative added that the Senate election collusion was orchestrated systematically, involving war rooms and call centers. Several candidates did not sign their own qualification certification forms (Form S.W.3) or even know who signed off on their expertise certifications. They questioned whether the EC is serving the public or other interests, noting that both the current EC and Constitutional Court members were appointed by the same Senate.
"The khaki uniform represents an honorable civil servant serving the people. But if the EC continues to benefit and whitewash cheaters, disregarding the public, I suggest they change their uniform to shorts instead," the reserve senators' representative concluded, urging the EC to promptly send the case files of 78 defendants to the Supreme Court for legal consideration without delay.
