A checklist of 44 former Move Forward Party MPs has been found by the National Anti-Corruption Commission (NACC) to have committed serious ethical violations for proposing to amend Section 112. The case will be sent to the Supreme Court. Among them, 10 won seats in the 2026 election and are preparing to enter parliament next term.

Regarding the case The National Anti-Corruption Commission (NACC) has completed its investigation into the case of 44 former Move Forward Party MPs involved in proposing an amendment to Criminal Code Section 112. The commission will vote on whether to issue a finding of guilt before sending the case to the Supreme Court for judgment, with reports that a decision was reached by late December 2025.

Most recently, on 9 Feb 2026, the NACC resolved to find 44 MPs guilty of serious ethical violations, stating their actions violated standards by failing to uphold the democratic system with the King as Head of State. The case and opinions will be sent to the Supreme Court for consideration and judgment within 30 days.

The origin of the case involving the 44 MPs

  • On 10 Feb 2021, 44 Move Forward Party MPs, led by party leader Pita Limjaroenrat, jointly submitted five draft bills to the Speaker of the Parliament. These included a bill to protect freedom of expression and rights in the justice process, as well as a draft amendment to Criminal Code Section 112.

  • On 2 Feb 2024, Mr. Teerayut Suwankesorn and Mr. Sontiya Sawatdee filed a complaint with the NACC to investigate and take ethical action against the Move Forward Party and the 44 MPs who proposed the Section 112 amendment.

  • On 7 Aug 2024, the Constitutional Court ruled to dissolve the Move Forward Party, citing actions aimed at overthrowing the monarchy related to the Section 112 amendment proposal, and banned the party’s executive committee from politics for 10 years.

  • The NACC established an investigative committee and completed the case file. The remaining step is to present it to the NACC commissioners for a vote. If a finding of guilt is issued, the case will be sent to the Supreme Court for judgment. If the accused hold MP positions, they must temporarily suspend their duties upon the court accepting the case. If the Supreme Court finds them guilty, they may face political disqualification for up to a lifetime or as determined by the court.
