Dr. Sorn invoked the Organization Act and the Constitution to counter the NBTC Board Nomination Committee's order to fine him 50,000 baht daily if he does not stop performing his duties. He stated the committee's authority ended once the full seven-member NBTC board was appointed and reserved the right to legally protect himself.

On 8 Oct 2026 GMT+7, Dr. Sorn Boonbaichaiyapruck, Chairman of the National Broadcasting and Telecommunications Commission (NBTC), assigned the NBTC Chairman's office to submit a letter opposing and disputing the administrative enforcement measures issued by Mr. Kiattipong Amatayakul, Chair of the NBTC Board Nomination Committee, who ordered Dr. Sorn to cease his duties within seven days and imposed a daily fine of 50,000 baht.

The document stated the objections as follows: 1. The Nomination Committee's authority ended long ago, as its mission as a special legal entity was completed when the Senate approved on 4 Sep 2021 GMT+7 and the Royal Command appointed the full seven-member NBTC board.

Therefore, the Nomination Committee’s powers ceased according to the mechanisms set in the Frequency Allocation Organization Act and align with the Constitutional Court ruling that clearly established “the Nomination Committee’s mission has ended and it has no continuing authority to interfere with the performance of duties.”

2. There is no reason for the Nomination Committee to consider using administrative enforcement measures under the Administrative Procedure Act, as the Frequency Allocation Organization Act does not authorize the committee to determine if appointees have violated laws or to order suspension of duties. Hence, the order is an overreach and unlawful interference with NBTC’s work.

3. The legal process is not final; the case is still under appeal before the Supreme Administrative Court. Accelerating administrative enforcement and imposing a hefty daily fine of 50,000 baht before the process concludes is unfair and imposes unreasonable pressure on the officeholder.

4. The referenced letter lacks sufficient and clear details and did not provide Dr. Sorn with relevant documents. It failed to transparently disclose meeting and voting details of the Nomination Committee, such as whether the vote occurred, where and when, whether the committee had a quorum, and each member’s opinion and vote. The letter was signed solely by Mr. Kiattipong Amatayakul, Chair of the Nomination Committee, without evidence of other members’ participation or approval.

5. The letter did not clarify the considerations or discretion applied in setting the disproportionately high fine, nor did it explain details about where, how, and to whom the fine should be paid.

The statement further requested the Nomination Committee to refrain from and suspend administrative enforcement and fine collection. It also asked for complete, clear meeting minutes and criteria for calculating the daily 50,000 baht fine. Dr. Sorn reserved all rights to pursue legal action to protect his rights and dignity in his work.
