On 3 Dec, Mr. Saiyut Pengboonchu, lawyer for Nana Raibina (also known as Raibina Intachai), 45, told the media that this morning officials from the Economic Crime Suppression Division (ECD) arrested Nana under warrants for fraud and the Loan Decree related to public fraud. Initially, police charged her under the Loan Decree concerning fraud against the public. She will be detained at the Central Investigation Bureau for booking, interrogation, and will be presented to court for detention tomorrow. He has prepared 500,000 baht bail to submit to the court for her release.
From discussions, Nana remains concerned about her child, bail, and work, as would be natural for someone who has never faced legal charges before.
Regarding details such as the number of victims, whether any are celebrities, and the amount of damage, he is unsure and must wait for the police to provide charges and details of the conduct. However, based on preliminary behavior, it involves borrowing money from multiple persons with agreements to pay interest exceeding legal limits, but ultimately failing to pay the promised interest. This case differs from The Icon case, which involved collusive public fraud, and is also different from pyramid scheme cases.
He also noted that on 1 December, they brought Nana to wait to surrender at the Central Investigation Bureau to show willingness to enter the justice process and that she had no intention to flee. However, the ECD police refused to accept her surrender or take any action. Then, on 2 December, the police issued an arrest warrant and conducted a raid to arrest her today. He said he did not know if this was the police trying to show results because issuing an arrest warrant implies the suspect is fleeing. But Nana had waited to surrender before the warrant was issued and did not attempt to flee, so issuing a warrant was unnecessary. It wasted government resources having over 10 officers conduct a raid.
