Special Prosecutors Explain Reasons for Seizing Lawyer Tums Assets, Cite Legal Framework, Plan Appeal

Special prosecutors emphasized they did not hasten to file the asset seizure petition against "Lawyer Tum" prematurely. They stated the process followed the legal 90-day timeframe. Assets worth over 73 million baht were seized to be returned to "Je Aoi," with plans to appeal within 30 days after the court rejected the petition.

On 24 Feb 2025 GMT+7, Mr. Suthep Yiamsiri, a specialist prosecutor at the Special Case Prosecutor's Office 2, disclosed details about seizing assets of Mr. Sitthira Biebbungkerd, or "Lawyer Tum." The seized assets consist of two parts. The first part relates to case number F26/2568, which prosecutors received in Feb 2025 GMT+7 and filed an investigation petition on 10 Mar 2025 GMT+7. These assets include bank funds, residential property, and land totaling more than 71 million baht.

The second part concerns case number F145/2568, which the Anti-Money Laundering Office (AMLO) submitted later on 30 Jul 2025 GMT+7. This includes 23 personal items such as branded handbags and laptops seized from the home, valued at over 2.6 million baht. Previously, AMLO had seized assets twice, but prosecutors combined these into one case due to their link to the same offense: fraud against Ms. Jatuporn Ubonlert, known as "Je Aoi." They confirmed the purpose of the seizure is to safeguard assets for return to the victim, not for state ownership. The criminal case will continue to address the issue of "gifts given out of affection."

Mr. Suthep affirmed that prosecutors did not file the petition prematurely, as the law requires submission within 90 days after asset seizure. The criminal and civil case grounds are separate. Authorities will next obtain copies of the court judgment to examine the reasoning thoroughly. If the court's rationale conflicts with legal provisions or evidence, they will proceed to file an appeal within 30 days according to legal procedures.
